If I’ve been charged, does that mean I’ll get a criminal record?
Not necessarily. A charge is the beginning of a legal process, not the end of it. There are a number of outcomes — including a section 10 dismissal — where a charge is dealt with by the court without a conviction being recorded. The right outcome depends on the nature of the charge, your history, and how the case is run. Getting proper legal advice early significantly widens the range of options available to you.
What does a section 10 dismissal mean?
A section 10 of the Crimes (Sentencing Procedure) Act 1999 (NSW) allows a court to find a person guilty of an offence but discharge them without recording a conviction. This means no criminal record, no fine and no sentence. It is not available in every case, but it is a realistic outcome in many matters — particularly for first-time offenders — when the case is properly prepared and presented.
How much will this cost?

How quickly do I need to get legal advice?
As early as possible. Do I need a lawyer if I’m planning to plead guilty?
Yes. A guilty plea doesn’t mean the outcome is predetermined. How the plea is entered, what material is put before the court, and how your circumstances are presented all affect what sentence you receive. A well-prepared plea in mitigation is often the difference between a conviction recorded and a section 10, or between a custodial and non-custodial sentence.
